Geddes City Council Meeting
Monday, September 9, 2024
The monthly meeting of the Geddes City Council was held at the City Finance Office in Geddes, SD. The meeting was called to order by Mayor, Mike Krietlow, at 7:30 p.m. with the following council members present: Carol Oberbroekling, Amy Rolland, Sue Schulte, Andy Kok and Sandy Gant. Also present was Donna Paulson, Finance Officer.
Established change to the agenda was computer training.
No public input.
Carol Oberbroekling made a motion to approve the August, 2024 minutes. Andy Kok seconded the motion. Motion carried unanimously.
August, 2024 financial reports were presented. A motion was made by Sue Schulte and seconded by Sandy Gant to approve these reports. Motion carried unanimously.
September, 2024 disbursements were presented. Carol Oberbroekling made a motion to approve the September, 2024 disbursements and Amy Rolland seconded the motion. Motion carried unanimously. Bills as followed were paid:

Old Business:
Donna informed the council that she has called Dale Strandberg several times and also emailed Damien with Astec and no response received back on our street project.
New Business:
The first reading of Ordinance 2025-01 2025 Annual Budget was held. Andy Kok made a motion to approve the 2025 Annual Budget. Carol Oberbroekling seconded the motion. Motion carried unanimously.

Discussion was held on the IM 28 regarding sales tax. After discussion, Sue Schulte made a motion to approve the following resolution. Andy Kok seconded the motion. Motion carried unanimously.
RESOLUTION 2024 – 02
CITY OF GEDDES, SOUTH DAKOTA
WHERESAS Initiated Measure 28 was certified for the November 2024 General Election Ballot by the South Dakota Secretary of State:
WHEREAS Initiated Measure 28, if passed, would remove state, municipal and tribal taxes on all items for human consumption except alcohol and prepared food;
WHEREAS “human consumption: is undefined in South Dakota Codified Law or the South Dakota Constitution. Black’s Law Dictionary defines “consumption” as “the act of destroying a thing by using it; the use of a thing in a way that exhausts it.”;
WHEREAS South Dakota Codified Law 34-45-1(7) defines tobacco products as “any item made of tobacco intended for human consumption, including cigarettes, cigars, pipe tobacco, and smokeless tobacco, and vapor products as defined in 34-46-20.”;
WHEREAS South Dakota Codified Law 10-52-2 allows incorporated municipalities to impose a tax on the sale, use, storage and consumption of items that conform in all respects to the state tax on such items up to two percent;
WHEREAS the Attorney General’s explanation of the measure states legislative or judicial clarification would be needed if the measure passes;
WHEREAS The City of Geddes levies a two percent sales tax and collected $119,069.60 in the 2023 fiscal year and $69,738.82 year-to-date in the 2024 fiscal year;
WHEREAS the City of Geddes estimates annual lost revenue of $8,000.00 unless Initiate Measure is rejected by voters in South Dakota.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of Geddes, that Initiated Measure 28 would negatively impact the municipal budget in our community.

Donna informed the council that she has received several complaints on the trees that were taken down at the north end of main street due to the drainage project. The city will contact B & H Tree Service to have them cut the trees into smaller pieces so that they can be hauled away.
Donna informed the council that she completed some computer training on the agenda, board responsibilities, etc. She learned that the establish change in the agenda should only be used on rare occasions, so Donna asked the council to text, email or call her with items for the agenda.
Building permit application from Linda Biddle was received. Sandy Gant made a motion to approve the building permit. Sue Schulte seconded the motion. Motion carried unanimously.
Carol Oberbroekling made a motion to adjourn at 7:52 p.m. Amy Rolland seconded the motion. Motion carried unanimously.
